Investigation of the Law on Preservation and Expansion of Green Space and Its Impact on Environmental Protection in Tehran

Abstract

Despite administrating numerous laws on the preservation and expansion of green spaces, urban management units have not been able to prevent the destruction of green spaces in the city of Tehran.
Studies and observations demonstrate extreme reduction of green space density to the extent that many sizeable green areas in the city have reduced to fragmented patches over the past decades, which raises questions about the efficiency of the current environmental management strategies.
This research investigates several factors which contribute to the destruction and transformation of green spaces in Tehran. These factors include: inadequacy of the existing law enforcement mechanisms, an extensive transformation of conservation areas to commercial or residential properties amid soaring land market prices, ineffective integration of urban management policies in city planning outlooks, and insufficient legislation to reduce adversarial attempts. The results also show that potential financial gains in many offence cases outweigh the provisioned criminal charges which incentivize offenders to undertake the associated risks.
To resolve the above issues, this study provides recommendations on how to establish more comprehensive legal frameworks, better integrate environmental governance units in urban decision- making councils, address management gaps and formulate more effective environment preservation solutions in the city of Tehran.
